Question: Is my company name and logo protected if I add the TM for trademark at the end of it?

I had a logo created that defines my company. This logo is unique and it includes the company name. I am focusing on building my brand and I just wanted to make sure that adding the TM at the end of the name and logo would be enough to claim ownership of it even though I created it. I want to make sure that copycats see this and realize that I am the owner of this brand. Any Suggestions…..

Answer: Although unique, it may create a likelihood of confusion with other existing trademarks. If it does, and the other trademarks existed before your trademark, you may be infringing.

Therefore, you may want to search for other conflicting trademarks and, if clear, register your trademark with the USPTO, rather than simply relying on the use of TM to indicate ownership.
