Question: Can I combine two existing patented ideas into one product and then publish/sell the result without infringing on those patents? I make cloth diapers by hand and am starting a home business to sell them online (very small scale). While I haven’t seen an example of my particular idea commercially or in the online sewing communities that I am a part of, it does combine the essentials from two existing patents. I have done a brief Google patent search and have not found anything matching my idea. My intention is to publish the idea/procedure on my business website in order to protect myself from future litigation as well as provide a new feature to fellow cloth diaper sewing enthusiasts. Would this work or would it be considered infringement?

 

Answer: If you are not changing the individual patented inventions when combined together, it would likely raise an infringement issue.
